1. Contract and provider
These terms govern the use of the frajtonarca service (the “service”) and purchases made within it. The service is provided, and all purchases are sold, by (the “provider”, “we”):
Pelechova cesta 24A, Preserje pri Radomljah, 1235 Radomlje, Slovenija
Registration number: 6349285000 · Tax number: 60393394 · not registered for VAT
Email: hej@frajtonarca.si · Telephone: 031 669 335
By creating an account or purchasing content, you accept these terms.
2. The service
Frajtonarca is an online classroom and marketplace for the diatonic accordion (frajtonarica). Vetted teachers create sheet music (for the virtual accordion and as PDF), sheet music bundles and video courses, which the provider sells; buyers obtain permanent access (a one-off purchase, no subscription). The platform includes a virtual accordion for practising along with the sheet music and lessons.
3. Account
When registering, you provide accurate information; you keep your sign-in secure and are responsible for activity under your account. You can sign in with your e-mail address and a password, a magic link, a one-time code (OTP) sent by e-mail or with Sign in with Google. You must be at least 16 years old.
4. Payments
- The seller of all content and the recipient of all payments is the provider (Simon Cerar s.p.). Teachers are the authors of the content; from each sale the provider pays them 70% and retains 30%.
- Purchases are one-off: you obtain permanent access to the purchased content.
- Payments are processed by Stripe (cards); we do not store card details.
- Prices are stated in EUR and are final. The provider is not registered for VAT: VAT is not charged pursuant to Article 94(1) of the ZDDV-1 (Slovenian Value Added Tax Act).
- You receive a proof of purchase and an invoice, fiscally verified with FURS (the Financial Administration of the Republic of Slovenia), by e-mail. If the purchase price is refunded, you receive a credit note.
5. Immediate delivery, withdrawal from the contract and refunds
All content is digital and is available to you immediately after payment (in your library, in the virtual accordion or for download, as the case may be).
Under the Consumer Protection Act (ZVPot-1), a consumer who buys online generally has the right to withdraw from the contract within 14 days. For digital content, this right ceases once performance has begun with the consumer’s express prior consent and their acknowledgement that they are aware of losing this right. Therefore, before every payment you expressly confirm that you consent to the immediate delivery of the digital content and are aware that you thereby lose your right to withdraw from the contract. We store your consent (the time of confirmation) with the purchase and confirm it in the proof of purchase.
Because you receive the purchased content immediately, we do not issue refunds. This does not affect your statutory rights if the content is not as described or does not work (e.g. a damaged or incomplete file). In that case, write to us at hej@frajtonarca.si and we will fix the fault, replace the content or, if that is not possible, refund the purchase price.
6. Teachers’ content
Teachers upload sheet music and videos for which they warrant that they hold all the necessary rights or permissions. Each teacher is solely responsible for the accuracy, lawfulness and quality of their content. The platform reserves the right to remove content that infringes these terms or applicable law.
Comments and ratings (thumbs up/down) are available exclusively to buyers, teachers and the platform’s administrators.
Reporting illegal content. If you believe that any content on the platform is illegal or infringes your rights (for example, copyright), write to us at hej@frajtonarca.si with the subject “Prijava vsebine” (content report). State the link to the content, why you believe it is illegal, your name and e-mail address and a statement that the information is, to the best of your knowledge, accurate. We review reports promptly and diligently and inform you and the teacher who published the content of our decision, with the reasons and the possibility to object.
7. Permitted use
It is prohibited to:
- infringe regulations or the rights of third parties;
- without the provider’s written consent, share or resell content you have obtained;
- attempt to circumvent payment or security mechanisms;
- access the service automatically on a large scale (scraping) or overload it;
- reverse-engineer any part of the platform.
8. Availability and changes to the service
We provide the service with the care of a prudent business operator, but without any guarantee of uninterrupted operation (maintenance, dependence on third-party providers). We may develop, change or discontinue features; we will give advance notice of any material deterioration of paid content.
9. Limitation of liability
To the fullest extent permitted by law: we are not liable for indirect damage, loss of profit or loss of data that does not result from our gross negligence or intent; the provider’s total liability is limited to the amount you paid for the service in the last 12 months. Nothing in these terms excludes any liability that cannot be excluded by law.
10. Termination
You may close your account at any time. If you breach these terms, we may temporarily restrict access or terminate the contract; in the case of breaches that can be remedied, we will first ask you to remedy them. After termination, we will give you access to the purchased content for a reasonable period, after which we will delete the account in accordance with the privacy policy.
11. Governing law and disputes
The law of the Republic of Slovenia applies. Disputes fall under the jurisdiction of the court with subject-matter jurisdiction in Ljubljana; for consumers, the jurisdiction rules under consumer protection legislation also apply. The EU platform for online dispute resolution: ec.europa.eu/consumers/odr.
12. Changes to the terms
We may update these terms; we will notify you of material changes in the app or by e-mail at least 15 days before they take effect. Continued use after they take effect constitutes acceptance.
